End User License Agreement (EULA) — Pathta for Excel

This End User License Agreement (the “Agreement”) governs the use of the “Pathta for Excel” add-in (the “Add-in”), published by NOW-CODE (SAS). By installing or using the Add-in, you fully accept this Agreement.

License

NOW-CODE grants the user a personal, non-exclusive and non-transferable right to use the Add-in, subject to holding a valid Pathta account. This right is granted solely for the intended use of the Add-in and confers no ownership rights over it.

Intellectual property

The Add-in, its code, interface, trademarks and all its components remain the exclusive property of NOW-CODE. The NOW-CODE trademark and logo are registered with the French INPI (No. 23 4 954 892). Any reproduction, representation, modification or distribution, in whole or in part, carried out without the prior written authorization of NOW-CODE, is prohibited and constitutes an infringement.

Limitation of liability

The Add-in is provided “as is”. NOW-CODE shall not be held liable for any direct or indirect damage resulting from the use of, or inability to use, the Add-in, in particular in the event of data loss, service interruption or inaccuracy of imported data. The user remains responsible for backing up their workbooks and for verifying the data processed.

Termination

The user may stop using the Add-in at any time by uninstalling it. NOW-CODE reserves the right to suspend or terminate access to the Add-in in the event of a breach of this Agreement or discontinuation of the Pathta service, without incurring any liability as a result.

Governing law and jurisdiction

This Agreement is governed by French law. In the event of any dispute regarding its interpretation or performance, and failing an amicable resolution, jurisdiction is expressly granted to the competent courts of the registered office of NOW-CODE, in Bordeaux, France.
